Agreement to these terms

By using hybrid5studio.com (the "site"), including the AI assistant, the 5-Pillar Scorecard, and the book-a-call form, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use the site.

If you use the site on behalf of a company, you confirm that you're authorized to accept these terms for that company, and "you" includes the company.

Who we are

The site is operated by Hybrid5 Studio ("Hybrid5 Studio," "we," "us," or "our"), based in Salt Lake City, Utah, USA. You can reach us at [email protected].

Using the site

You may use the site for lawful purposes, such as learning about our services, taking the scorecard, chatting with the assistant, and booking a call. When you use the site, you agree not to:

• Break any law or regulation, or help anyone else do so
• Scrape, crawl, or harvest content or data from the site with automated tools, other than standard search engine indexing
• Overload, disrupt, or abuse the site, its forms, or the AI assistant, including through spam or automated submissions
• Probe, scan, or test the site's security, or try to get around any security or access controls
• Try to manipulate the AI assistant, or extract its instructions or configuration, in order to misuse it or cause harm
• Submit false information, impersonate anyone, or send content that is unlawful, harmful, or violates someone else's rights
• Send viruses, malware, or any other harmful code

We may limit, suspend, or block access to the site or any of its features if we believe someone is breaking these terms.

The AI assistant

The chat assistant on the site is an AI. It answers general questions about Hybrid5 Studio and our services, and it can be wrong, incomplete, or out of date.

• What the assistant says is for general information only.
• It is not legal, financial, tax, or other professional advice.
• It is not an offer, a quote, or a contract.
• Nothing the assistant says binds Hybrid5 Studio until a person at Hybrid5 Studio confirms it in writing.

You can ask for a human at any time. Please don't share sensitive information in the chat, such as passwords, payment card numbers, or health details. Our Privacy Policy explains how chat messages are handled.

The 5-Pillar Scorecard

The scorecard offers general guidance based on your yes or no answers. It's a starting point for a conversation, and it doesn't replace a real review of your business. Your results and any full report don't guarantee any particular outcome.

Booking a call

When you book a call through the site, you're sending a request. A person at Hybrid5 Studio confirms the time with you. We may need to reschedule, and if we do, we'll let you know.

There is no fee for the intro call. Booking one doesn't obligate you or us to any further work.

Proposals and paid work

Any paid work is covered by a separate written agreement, such as a signed proposal or contract. If that agreement conflicts with these terms, the written agreement controls.

Any pricing, timelines, or scope mentioned on the site, including by the AI assistant, are only estimates until they appear in a written agreement.

Intellectual property

Hybrid5 Studio owns the site and its content, including the text, graphics, design, code, the Hybrid5 Studio name and logo, and the tagline "Half human. Half AI. All business." Some content may belong to our licensors. All of it is protected by intellectual property laws.

We give you a limited, personal, non-exclusive, non-transferable, revocable license to view and use the site for your own information. You may not copy, modify, distribute, sell, or create derivative works from site content, or use our name, logo, or tagline, without our written permission.

What you send us

When you send us something through the site, such as scorecard answers, booking details, notes, or chat messages, you give us permission to use it to respond to you and provide what you asked for, as described in our Privacy Policy. You're responsible for what you send, and you confirm you have the right to share it.

Please don't send confidential information through the site. Anything you send through the site is not treated as confidential unless we agree otherwise in writing.

If you send us ideas or feedback, we may use them without any obligation to you.

Third-party links and services

The site may link to other websites or rely on outside services, such as the providers listed in our Privacy Policy. We don't control third-party sites or services and aren't responsible for their content, policies, or practices. Your use of them is at your own risk and subject to their terms.

Disclaimers

We work to keep the site accurate and running well. Even so, we provide the site, the scorecard, and the AI assistant "as is" and "as available."

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We don't promise that the site will be accurate, complete, uninterrupted, secure, or free of errors or harmful components.

Content on the site is general information. It is not professional advice for your specific situation.

Limitation of liability

To the fullest extent permitted by law, Hybrid5 Studio and its affiliates, owners, employees, and contractors won't be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, revenue, data, or goodwill, arising from or related to your use of the site, even if we were told such damages were possible.

To the fullest extent permitted by law, our total liability for any claim arising from or related to your use of the site is limited to $100.

Some places don't allow these limits, so some of them may not apply to you. Liability for paid work is governed by the written agreement for that work.

Indemnity

You agree to defend, indemnify, and hold harmless Hybrid5 Studio and its affiliates, owners, employees, and contractors from any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from your misuse of the site, your violation of these terms, or your violation of any law or anyone else's rights.

Governing law and venue

These terms are governed by the laws of the State of Utah, without regard to its conflict of law rules. Any dispute arising from or related to these terms or the site will be brought only in the state or federal courts located in Salt Lake County, Utah. You and we both consent to the personal jurisdiction of those courts.

Changes to these terms

We may update these terms from time to time. When we do, we'll post the new version on this page with a new "last updated" date. If you keep using the site after the changes take effect, you accept the updated terms.

General

If any part of these terms is found unenforceable, the rest stays in effect. If we don't enforce part of these terms right away, we can still enforce it later. These terms and our Privacy Policy make up the full agreement between you and us about using the site. Paid work is governed by its own written agreement.
